The new migration legislation in Spain for 2025 entails changes in the integration of migrants: These modifications simplify processes and expand opportunities for those who wish to build their future in Spain.
This legislation modernises the migration system with a humane and practical approach, as stated by Minister Elma Saiz:
‘We must allow people to realise their life project in Spain by facilitating changes of status, for example, if a student comes to train and then joins the labour market, or if a regrouped family member decides to obtain a work permit of their own.
New Visa and Residence Opportunities
Initial residence and work authorisations are extended for one year and do not need to be renewed for up to four years, thus avoiding illogical bureaucratic processes such as the need to leave the country before applying for long-term residence after a temporary one, a change that facilitates continuity and stability for migrants.
The job-seeker’s visa is also extended to one year, a measure designed to help both active job seekers and companies in need of qualified personnel. This visa allows the applicant to seek employment in specific occupations, maximising the chances of finding a job suited to the applicant’s professional profile.
Facilities for Students and Change of Status

Foreign students will be able to benefit from permits of stay aligned with the duration of their training and work up to 30 hours per week while studying. Once they have completed their training, they will have an additional year to seek employment without the need to renew their visa.
In addition, a fast-track procedure is introduced to transform the study permit into a residence and work permit, adding this period to the two-year period required to apply for Spanish nationality.
The ‘Arraigo por Formación’ and Other Regularisation Paths
Among the new features is the new ‘Arraigo por Formación’ permit, aimed at people who have been resident in Spain for at least two years. This permit allows them to regularise their situation by committing to undertake regulated training to improve their employability.
The modalities of arraigo are also extended, including family, social, socio-occupational, second chance and socio-training arraigo, reducing the requirements and shortening the application deadlines.
Improvements to Family Reunification
Family reunification becomes more accessible, extending the maximum age for reunited children to 26 years and automatically granting work authorisation to reunited family members. This encourages faster and fuller integration, both socially and economically.
Protection Against Labour Exploitation and Support for Enterprises
The new regulation also prioritises the protection of migrants’ labour rights, allowing them to change employers in case of abusive conditions. It also simplifies the procedures for companies wishing to hire migrant workers, thus favouring job creation.
